Abstract: The hypothesis in this article is “The Protection and Promotion of Thai Traditional Medicine Wisdom Act, B.E. 2542 fits all of the Thai traditional medicine knowledge protection.” Currently, the protection has not helped communities to manage their national resources and knowledge. Consequently, the biopiracy problem concerning benefit cooperation of indigenous or local communities is still breathing without fairness. In order to help the public understand and be profound of the situation, this study plays two main roles. First, it provides a conceptual framework to analyze the dilemma of Thai traditional medical knowledge protection with the new orientalism. Second, it describes the harmonization between the community rights and the protection and promotion of Thai traditional medicine in order to add the Thai community traditional medicine knowledge into the Protection and Promotion of Thai Traditional Medicine Wisdom Act, B.E. 2542 without registration.
