ในปัจจุบันจากสถานะการณ์ Covid-19 ซึ่งยังไม่ทราบว่าจะจบลงเมื่อใด ทำให้มีผลกระทบต่อการดำเนิน กิจการของบริษัทเอกชนหลายๆ แห่ง ซึ่งอาจมีความจำเป็นที่จะมีการเลิกจ้างบุคลากรโดยเฉพาะบุคลากรประเภทสัญญาจ้างแบบมีกำหนดระยะเวลา มีประเด็นปัญหาที่ต้องวิเคราะห์ 3 ประเด็นด้วยกัน กล่าวคือ ประเด็นที่หนึ่ง สัญญาจ้างที่มีกำหนดระยะเวลา หากนายจ้างเลิกจ้างเมื่อครบกำหนดสัญญาถือว่าเป็นการเลิกจ้างโดยไม่เป็นธรรมหรือไม่ ประเด็นที่สอง สัญญาจ้างที่มีกำหนดระยะเวลา หากนายจ้างเลิกจ้างต้องมีการบอกกล่าวล่วงหน้าหรือไม่ และประเด็นที่สาม สัญญาจ้างที่มีกำหนดระยะเวลา หากนายจ้างเลิกจ้างจะต้องจ่ายค่าชดเชยหรือไม่ ทั้งนี้ พิจารณาจากประมวลกฎหมายแพ่งและพาณิชย์ พระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 พระราชบัญญัติจัดตั้งศาลแรงงานและวิธีพิจารณาคดีแรงงาน พ.ศ. 2522 คำวินิจฉัยของศาลฎีกา และคำวินิจฉัยของศาลอุทธรณ์คดีชำนัญพิเศษ
The COVID-19 pandemic is an ongoing global problem which affects many businesses in the private sector. These businesses may befacing cost cutting plans which include laying off workers, in particular those workers with contract of employment for a specified duration. Three issues need to be analyzed as follows. First, in a contract of employment for a specified duration, is it legal for the employer to terminate the contract once the specified duration is met? Second, must the employer give an advance notice for the termination of the contract of employment for a specified duration? And, third, is there worker compensation should the contract be terminated? This is analysed according to the Civil and Commercial Code, Labor Protection Act 1998, Act on the Establishment of and Procedure for Labor Court 1979, Ruling of the Supreme Court and Ruling of the Specialized Court of Appeal.
