ทิศทางการจัดการเรียนการสอนหลักสูตรนิติศาสตรบัณฑิตในประเทศไทย

Abstract

บทความวิชาการนี้ มุ่งที่จะชี้ให้เห็นถึงทิศทางการจัดการเรียนการสอนหลักสูตรนิติศาสตรบัณฑิตในประเทศไทยที่ต้องเปลี่ยนแปลงไป มิได้มุ่งแต่เพียงให้ผู้เรียนศึกษาหลักกฎหมายบ้านเมืองที่ใช้ในสังคมเท่านั้น แต่ต้องเข้าใจถึงบริบทแวดล้อมที่เชื่อมโยงกับกฎหมาย อาทิ ประวัติศาสตร์ ปรัชญา การเมือง สังคมวิทยา เศรษฐศาสตร์ ตลอดจน ปัจจุบัน มีปัจจัยที่ส่งผลกระทบต่อการจัดการเรียนการสอน ไม่ว่าจะเป็นความต้องการของผู้ใช้บัณฑิต การจัดการเรียนการสอนเชิงรุก สถานการณ์โควิด-19 ซึ่งเป็นสิ่งที่หลักสูตรต้องปรับตัว เพื่อให้สามารถผลิตบัณฑิตที่มีความรู้กฎหมายพื้นฐาน มีทักษะปฏิบัติที่จ าเป็นต่อการประกอบวิชาชีพ มีวิธีคิดในทางกฎหมายหรือนิติวิธีที่สามารถศึกษาต่อยอดความรู้กฎหมายใหม่ๆ มีความรู้เบื้องต้นในศาสตร์ด้านอื่น ๆ และมีคุณธรรมจริยธรรมทางวิชาชีพ

This paper reports on the current implementation of and changes in the curricula for the Bachelor of Laws (LLB) in Thailand. One significant point of this paper is that the current LLB programmes in Thailand aim to equip law students with not only solid understanding of the principles of law but also the integration between laws and other disciplines (e.g., history, philosophy, sociology, economics). Other promising factors affecting the implementation of those LLB programmes, e.g. the expectation of stakeholders, the adoption of active learning approach, unprecedented COVID-19 pandemic, are also discussed. Finally, this paper concludes with a discussion of ways to implement those LLB programmes in relation to the enhancement of students’ knowledge of law principles, professional skills for law-related jobs, and ability to use juristic method, which can encourage students to foster their law as well as other disciplinary knowledge with professional ethics.
