ในปัจจุบันประเทศไทยได้เข้าสู่สังคมผู้สูงอายุ ทำให้ธุรกิจต่าง ๆ มุ่งเน้นไปในทิศทางที่จะตอบสนองความต้องการของผู้สูงอายุเพิ่มมากขึ้น ธุรกิจหนึ่งคือธุรกิจประกันชีวิตของผู้สูงอายุ ที่มีการประชาสัมพันธ์มากมายหลายบริษัทว่าไม่ต้องตรวจและไม่ต้องตอบคำถามสุขภาพใด ๆ สมัครง่าย ๆ แค่โทร แต่ปัญหาที่เกิดขึ้นปรากฏว่า มีการบอกล้างสัญญาประกันชีวิตโดยอ้างว่า สัญญาประกันชีวิตตกเป็นโมฆียะ เนื่องจากผู้เอาประกันภัยปกปิดข้อเท็จจริง โดยรู้อยู่แล้วละเว้นเสียไม่เปิดเผยข้อความจริงซึ่งอาจจะได้จูงใจผู้รับประกันภัยให้เรียกประกันภัยสูงขึ้นอีกหรือบอกปัดไม่ยอมทำสัญญา หรือรู้ว่าข้อความที่แถลงนั้นเป็นความเท็จ ตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 865 มีผลทำให้ผู้เอาประกันภัยหรือผู้รับประโยชน์ไม่ได้รับเงินตามประกันชีวิตตามตนได้มุ่งหวังไว้ ซึ่งการเปิดเผยข้อเท็จจริงตามมาตราดังกล่าวถือว่า เป็นหน้าที่ของผู้เอาประกันภัยจะต้องแจ้งแก่ผู้รับประกันภัยรับทราบในขณะขอเข้าทำสัญญาประกันชีวิต
At this juncture of time, Thailand has entered into an aging and elderly society. Businesses are already increasingly focused on the direction to meet the demands of the elderly population. One example is the life insurance business for the elderly, many of which advertise that insurance buyers do not need a previous health screening or check-up and that they do not have to answer to any health pertaining questions. These insurance policies create a no-fuss, just one phone call away, and easy to apply for life insurance scheme. But the problem is that there have been claims to nullify the life insurance. The assured becomes void because policy buyers falsely report their pre-existing health conditions when they enroll into the policy, deliberately ignore and not stating the truth, in order to save on their insurance health coverage. Otherwise, health insurance costs can increase or the insurance can outright refuse the health insurance. And under false pretense from the policy buyer, according to the Civil and Commercial Code Section 865, the assured or the beneficiary will not receive any compensation according to their entitlement.
