การศึกษาเรื่องคุณภาพชีวิตภายใต้รัฐธรรมนูญฉบับปี พ.ศ. 2550 และกฎหมายที่เกี่ยวข้องเป็นงานวิจัยที่สนับสนุนโดยสภาที่ปรึกษาเศรษฐกิจและสังคมแห่งชาติ มีวัตถุประสงค์หลัก เพื่อศึกษาเจตนารมณ์และสาระในการพิทักษ์ ส่งเสริมสิทธิเสรีภาพและโอกาสในการพัฒนาคุณภาพชีวิตสตรี ภายใต้กฎหมายรัฐธรรมนูญ พ.ศ. 2550 รวมถึงอนุสัญญาระหว่างประเทศ แผนพัฒนาเศรษฐกิจและสังคมแห่งชาติฉบับที่ 10 แผนพัฒนาสตรีของหน่วยงานภาครัฐและองค์กรเอกชนในระดับท้องถิ่น และกฎหมายที่เกี่ยวข้อง
การศึกษาได้ทำทั้งในเชิงปริมาณและเชิงคุณภาพ การศึกษาเชิงปริมาณได้เก็บข้อมูลเรื่องความรุนแรงต่อสตรีจากสตรีที่สมรสแล้วจำนวน 1,000 คน จาก 4 ภาค รวมทั้งกรุงเทพมหานคร และจากองค์การบริหารส่วนตำบล (อบต.) จำนวน 115 แห่ง เรื่องนโยบายและแผนงานด้านสตรีของภาครัฐในระดับท้องถิ่น การศึกษาเชิงคุณภาพทำโดยการจัดประชุมกลุ่มย่อยผู้นำสตรีทุกภูมิภาค จำนวน 5 ครั้ง มีผู้เข้าร่วมทั้งหมด 65 คน และสัมภาษณ์ผู้เชี่ยวชาญงานสตรีระดับลึก จำนวน 8 คน เพื่อเก็บข้อมูลในด้านคุณภาพชีวิตสตรี และงานพัฒนาสตรีของภาครัฐและภาคเอกชน ผลการศึกษาพบว่าแม้เจตนารมณ์ของรัฐธรรมนูญ พ.ศ. 2550 จะเน้นในเรื่องความเท่าเทียมกันทางเพศ การลดอคติทางเพศ การปกป้องสิทธิ และความเป็นเอกภาพและมีส่วนร่วมของครอบครัวแต่สตรีไทยส่วนใหญ่ยังคงไม่รู้สิทธิและวิธีการเข้าถึงสิทธิ ส่วนผู้ปฏิบัติงานก็ไม่เข้าใจเจตนารมณ์ที่แท้จริงของกฎหมาย สตรีจำนวนหนึ่งในสามยังเผชิญกับความรุนแรงในครอบครัว ภาครัฐเป็นกลไกหลักในการพัฒนาสตรี โดยมีสำนักงานกิจการสตรีและสถาบันครอบครัว กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ เป็นหน่วยงานรับผิดชอบหลัก ในส่วนองค์การบริหารส่วนตำบลมีการจัดสรรงบประมาณในการพัฒนาสตรีจำนวนน้อยเพียงร้อยละ 4.83 ในปี พ.ศ. 2550 และมีสัดส่วนลดลงเป็นร้อยละ 3.94 ในปีพ.ศ. 2551
This article aimed to present the findings of the research on “Quality of Life of Thai Women under the 2007 Constitution and Related Laws”. This research was funded by Thai National and Economic Advisory Council. The main objective was to study the intention of the 2007 Constitution and its contents on rights protection, promotion of liberation and opportunity to develop the quality of life of women.
Findings were concluded from the qualitative and quantitative data analysis. Quantitative data were collected from 1,000 married women from 4 regions of Thailand including Bangkok to determine the incidence of violence against women in 115 Tambon Administrative Organizations. Also, information about the policies and work plans for women development of the local governmental offices was gathered. Qualitative data which emphasized the quality of life of women and works of women development, of both governmental and private sectors, were collected by focused group discussions of 65 female leaders in 5 forums and in-depth interviews of 8 experts in women’s studies.
Findings indicated that although the intention of the 2007 Constitution emphasized gender equality, lessening of gender bias, protection of rights, family unity and participation; most target groups did not know their rights and how to approach to their rights. Implementation officers did not understand the real intention of the law. Approximately, one third of women still faced domestic violence. The governmental sector, through the Women and Family Affairs Office under Ministry of Social Development and Human Security, is still the main mechanism with responsibility for women’ s development. At present, the Tambon Administrative Organization allocated very low funds for women’s development, only 4.83% in 2007 and even lower, 3.94% in 2008.
