การขยายการคุ้มครองทางสังคมแบบยั่งยืนสำหรับแรงงานนอกระบบในประเทศไทย

Abstract

การวิจัยเรื่อง “การขยายการคุ้มครองทางสังคมแบบยั่งยืนสำหรับแรงงานนอกระบบในประเทศไทย” มีวัตถุประสงค์ 4 ประการ คือ เพื่อศึกษาสถานการณ์ปัญหา และผลกระทบจากการแพร่ระบาดของไวรัสโควิด-19 ต่อแรงงานนอกระบบ เพื่อศึกษาระบบสวัสดิการสังคม และการคุ้มครองทางสังคมสำหรับแรงงานนอกระบบที่มีอยู่ในปัจจุบัน เพื่อประเมินมาตรการให้ความช่วยเหลือเฉพาะหน้า ของรัฐบาลต่อแรงงานนอกระบบและปัญหา อุปสรรคในการเข้าถึง และเพื่อเสนอนโยบายและมาตรการ ในการขยายการคุ้มครองทางสังคมอย่างยั่งยืน เป็นการวิจัยเชิงคุณภาพ เก็บข้อมูลโดยการจัดสนทนากลุ่มผู้รับงานไปทำที่บ้าน การสัมภาษณ์เจาะลึกแรงงานนอกระบบภาคบริการผลการวิจัยพบว่า การแพร่ระบาดของไวรัสโควิด-19 ในประเทศไทยส่งผลกระทบต่อแรงงานนอกระบบทั้งคนไทยและคนต่างชาติด้านสุขภาพจิต ด้านรายได้ และด้านคุณภาพชีวิตที่ต่ำลง ระบบสวัสดิการสังคมและการคุ้มครองทางสังคมสำหรับแรงงานนอกระบบที่มีอยู่ในปัจจุบันไม่สามารถ ช่วยให้แรงงานนอกระบบมีหลักประกันหรือมีความมั่นคงได้จริง การให้ความช่วยเหลือของรัฐบาล เป็นการช่วยเหลือเฉพาะหน้าซึ่งไม่ยั่งยืนผู้วิจัยมีข้อเสนอแนะต่อรัฐบาลให้ใช้นโยบาย “การคุ้มครองทางสังคมถ้วนหน้า” บูรณาการหน่วยงานที่เกี่ยวข้องกับการจัดสวัสดิการสังคม และการคุ้มครองทางสังคมสำหรับแรงงานนอกระบบ โดยกำหนดภารกิจของแต่ละกระทรวงให้ชัดเจน ปรับปรุง พ.ร.บ. ประกันสังคม โดยการขยายสิทธิประโยชน์ผู้ประกันตนมาตรา 40 ที่เป็นแรงงานนอกระบบให้มีสิทธิประโยชน์ให้ใกล้เคียง กับผู้ประกันตนมาตรา 39 กระทรวงแรงงานออกกฎกระทรวง หรือประกาศกระทรวง เพื่อการบังคับใช้กฎหมายตาม พ.ร.บ. คุ้มครองผู้รับงานไปทำที่บ้าน พ.ศ. 2553 มาตรา 14 มาตรา 21 และมาตรา 24 จัดทำฐานข้อมูลกลุ่มแรงงานนอกระบบให้ชัดเจน ปรับปรุงการบริหารจัดการกองทุนส่งเสริมอาชีพแรงงานนอกระบบโดยให้ผู้แทนของสมาพันธ์แรงงานนอกระบบมีส่วนร่วม เชื่อมเครือข่ายระบบการคุ้มครองช่วยเหลือของภาครัฐที่มีอยู่ทั้งในระดับท้องถิ่นและระดับชาติให้ชัดเจน

The research on “Extending Sustainable Social Protection for Informal Workers in Thailand” has four objectives: to study the problem situation and the impact of the COVID-19 epidemic on informal workers, to study the existing social welfare system and social protection for informal workers, to assess measures to provide immediate government assistance to informal workers and their problems barriers to access and to propose policies and measures to expand sustainable social protection. The research employed a qualitative method to collect data by organizing a focus group discussion, and in-depth interviews with informal sector workers. The results showed that the spread of the covid-19 virus in Thailand have affected informal workers, both Thais and foreigners in terms of mental health, and lower quality of life. The social welfare system and the social protection for informal workers that exist today cannot provide security or security for informal workers. Government assistance is immediate and unsustainable. The researcher suggests the government to implement the policy “Protection for universal society,” integrates agencies involved in social welfare provision and social protection for informal sector by defining the mission of each ministry clearly, improving the Social Security Act by expanding the benefits of Section 40 insured workers who are informal sector to have benefits that are close to those insured under Section 39, issue ministerial regulations or ministry announcements to enforce the law in detail according to the Home Workers Protection Act, 2010, Section 14, Section 21 and Section 24, provide a clear database of informal sector, improve the management of the Informal Sector Occupation Promotion Fund by engaging representatives of the Informal Sector Federation, clearly link the network of government aid protection systems at both local and national levels.
