Abstract

สิทธิการรับมรดกของคู่สมรสในที่นี้จะกล่าวถึงสิทธิในการรับมรดกของคู่สมรสโดยชอบด้วยกฎหมายและคู่สมรสโดยมิชอบด้วยกฎหมายที่ยังมีชีวิตอยู่ ว่ามีสิทธิรับมรดกของคู่สมรสที่ถึงแก่ความตายได้ในฐานะใด ถ้าเป็นคู่สมรสโดยชอบด้วยกฎหมายมีสิทธิรับมรดกได้ในฐานะทายาทโดยธรรมตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา ๑๖๒๙ หากเป็นคู่สมรสโดยมิชอบด้วยกฎหมายไม่มีฐานะเป็นทายาทโดยธรรมย่อมไม่มีสิทธิรับมรดกของคู่สมรสที่ถึงแก่ความตาย แต่สามารถขอแบ่งทรัพย์สินที่หาได้ร่วมกันในขณะที่ยังมีชีวิตอยู่ได้ในฐานะเป็นเจ้าของกรรมสิทธิ์ร่วมกันคนละครึ่ง นอกจากนี้แล้วคู่สมรสโดยชอบด้วยกฎหมายและคู่สมรสโดยมิชอบด้วยกฎหมายอาจเป็นทายาทในฐานะผู้รับพินัยกรรมได้ เมื่อคู่สมรสที่ถึงแก่ความตายได้แสดงเจตนาโดยพินัยกรรมกำหนดการเผื่อตายในเรื่องทรัพย์สินของตนไว้แล้ว กรณีก็จะเป็นไปตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา ๑๖๔๖

The core theme of this article is dealt with determining how and whether the rights to the succession of living legal and illegal spouses can be functioned under the Thai Civil and Commercial Code. From the discussion, it becomes clear that Section 1629 under the Code endorses the legal spouses to be as statutory heir and those are entitled to inherit; in contrast, the illegal spouses are not provided such legal status but the illegal spouses can have the right to claim all equal share of their properties earned during they are alive and live together as the de facto spouses. Although the illegal spouses are not the statutory heir, both living legal and illegal spouses are, under Section 1646 under the Code, recognized as lawful heir by will of de cejus.
