การวัดความเชื่อมั่นต่อระบบงานยุติธรรมและ การอํานวยความยุติธรรมของกระทรวงยุติธรรม ประจําปีงบประมาณ 2555

Abstract

การศึกษาวิจัยเรื่อง การวัดความเชื่อมั่นต่อระบบงานยุติธรรมและการอํานวยความยุติธรรมของกระทรวงยุติธรรม ประจําปีงบประมาณ 2555 มีวัตถุประสงค์ (1) เพื่อวัดระดับความเชื่อมั่นต่อการอํานวยความยุติธรรมของกระทรวงยุติธรรม (2) เพื่อวิเคราะห์ปัญหาและอุปสรรคที่มีผลต่อความเชื่อมั่นของประชาชนในการอํานวยความยุติธรรมของกระทรวงยุติธรรม ด้วยวิธีวิจัยเชิงปริมาณ กลุ่มตัวอย่างคือ ประชากรโดยใช้ข้อมูลจํานวนประชากรจากสถิติการใช้บริการของหน่วยงานในสังกัดกระทรวงยุติธรรม ณ เดือนกันยายน 2554 ดังนี้คือ กลุ่มที่ 1 จํานวนประชากร 2,135 ราย จากสถิติผู้มายื่นคําร้องทุกข์ ณ สํานักงานยุติธรรมจังหวัด กลุ่มที่ 2 จํานวนประชากร 95 ราย จากสถิติผลการดําเนินงานกองทุนยุติธรรมสูงสุด กลุ่มที่ 3 จํานวนประชากร 121 รายจากสถิติการจ่ายเงินของสํานักงานช่วยเหลือทางการเงินแก่ผู้เสียหายและจําเลยในคดีอาญา กลุ่มที่ 4 จํานวนประชากร 85 ราย จากสถิติรายงานประจําปี 2554 การให้ความคุ้มครองพยาน กลุ่มที่ 5 จํานวนประชากร 250 ราย จากกลุ่มผู้มีส่วนได้เสียอื่นๆ จํานวน 25 กลุ่ม รวมจํานวนประชากรทั้งสิ้น 2,686 ราย และกลุ่มที่ 6 ประชาชนทั่วไป ประชากรทั้งประเทศ จํานวน 64,413,000 ราย ตามสูตรการคํานวณขนาดตัวอย่างที่มีขนาดใหญ่ของ Taro Yamane คือ 400 ราย โดยการแจกแบบสอบถาม

ผลการวิจัยพบว่า (1) ความเชื่อมั่นด้านการอํานวยความยุติธรรมของกระทรวงยุติธรรมเป็นไปตามหลักนิติธรรม มาตรฐานสากล และพันธกรณีข้อตกลงระหว่างประเทศที่ไทยเข้าร่วม (2) ปัญหาและอุปสรรคที่มีผลต่อความเชื่อมั่นของประชาชน ในการอํานวยความยุติธรรมของกระทรวงยุติธรรม เรียงตามลําดับดังนี้ 1) การปฏิบัติงานล่าช้า 2) การประชาสัมพันธ์บทบาทภารกิจยังไม่ชัดเจนครอบคลุมและทั่วถึง 3) ระบบอุปถัมภ์ การเลือกปฏิบัติระหว่างคนจนกับคนรวยและ 4) เจ้าหน้าที่ทุจริต ไม่มีความยุติธรรม

The research title was “the reliance upon justice system provided by ministry of justice in fiscal year 2012”to be dealt with determining the confidence level of the equity of the Ministry of justice and any existing legal problems adversely affecting the confidence of Thai people to the Ministry of Justice. The research is also to provide what are satisfactory level of Thai people to Thai justice system as well as the equity of the Ministry of Justice. Therefore, this would be very important to redesign and develop the justice system process and the roles of the Ministry of Justice in order to promptly promote and strengthen Thai people’s confidence to the justice system and the equity of the Ministry of justice.The research results found that individual factors : the reliance upon Thai justice system provided by Ministry of Justice has been satisfyingly recognized and such system has also effectively been in line with international guidance as well as obligation which Thailand has consented to be bound because, in regard to the study, the reliance can be tangibly indicated as a percentage range between 60 to 69 percent for ten governmental organs studied in the research. Nevertheless, in order to more effectively develop and improve those organs’ reliance, this research aims to propose that those should strongly concentrate on what people are to be provided in terms of justice service. The organs shall not strictly comply with any existing laws or regulations only, but such organs’ practice shall also be relevant to general framework e.g. good governance and the rule of law principle. Furthermore, specific framework e.g. the international human right rule or the proof investigation process must be effectively applied in operation and the justice can be guaranteed and can serve Thai people through the legislation process which is relevant to international obligations.
