การปฏิบัติงานแบบสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ

Abstract

การศึกษาเรื่องการปฏิบัติงานแบบสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกระทำทารุณกรรมทางเพศมีวัตถุประสงค์เพื่อศึกษาถึงปัญหาและอุปสรรคการปฏิบัติงานแบบสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ ตลอดจนศึกษาแนวทางการปฏิบัติงานแบบสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ โดยผู้ศึกษาทำการศึกษากับผู้ปฏิบัติงานด้านให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ ประกอบด้วยแพทย์ พยาบาล นักสังคมสงเคราะห์ นักจิตวิทยา ตำรวจ และอัยการ ซึ่งได้ปฏิบัติงานตามหน่วยงานต่าง ๆ ทั้งหน่วยงานภาครัฐและภาคเอกชนเฉพาะในเขตกรุงเทพมหานครและเขตปริมณฑล ลักษณะเนื้อหาในการศึกษาเป็นเรื่องเกี่ยวกับความรู้ความเข้าใจการปฏิบัติงานแบบสหวิชาชีพ จรรยาบรรณวิชาชีพและมาตรการทางกฎหมาย แนวทางการปฏิบัติงานสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ ผลการศึกษาพบว่าปัญหาและอุปสรรคการปฏิบัติงานแบบสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ มีลักษณะความสำคัญดังนี้ 1.ปัญหาและอุปสรรคด้านนโยบาย พบว่าปัญหาด้านนโยบายมีลักษณะไม่ชัดเจนและไม่ต่อเนื่อง ส่งผลให้แนวทางการปฏิบัติงานแบบสหวิชาชีพไม่เป็นไปในทิศทางเดียวกัน ทำให้มุมมองทัศนคติในการมองประเด็นปัญหามีลักษณะแตกต่างกัน 2.ปัญหาและอุปสรรคด้านกระบวนการ ขึ้นตอนในการปฏิบัติพบว่าเป็นปัญหาด้านงบประมาณที่ไม่สนับสนุนการปฏิบัติงานแบบสหวิชาชีพ ทำให้การปฏิบัติงานแบบสหวิชาชีพผ่านมาไม่จริงจังเท่าที่ควร ลักษณะการให้ความช่วยเหลือเป็นไปอย่างล่าช้า โดยเฉพาะงบประมาณจากหน่วยงานภาครัฐที่มาสนับสนุนการปฏิบัติงานแบบสหวิชาชีพมีน้อยมาก ผู้ปฏิบัติงานส่วนใหญ่จึงขาดแรงจูงใจในการปฏิบัติงาน ปัญหาที่ตามมาคือวัสดุอุปกรณ์ที่จำเป็นในการปฏิบัติงานให้ความช่วยเหลือมีอย่างจำกัด ทำให้การดำเนินงานขาดประสิทธิภาพ 3.ปัญหาและอุปสรรคด้านการประสานงาน พบว่าการประสานงานเป็นปัญหาอย่างหนึ่งที่มีผลต่อการปฏิบัติงานแบบสหวิชาชีพ ทำให้การปฏิบัติงานมีลักษณะซ้ำซ้อนไม่รู้ไม่เข้าใจงานที่รับมอบหมาย เกิดความขัดแย้งภายในจิตใจกันระหว่างผู้ร่วมปฏิบัติงาน บางครั้งไม่ได้รับความร่วมมือในการปฏิบัติงานเท่าที่ควร 4.ปัญหาและอุปสรรคด้านความพร้อมของบุคลากร พบว่า บุคลากรส่วนใหญ่มีความชำนาญในการปฏิบัติงานแบบสหวิชาชีพการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ ไม่เพียงพอ และขาดศักยภาพในการปฏิบัติงาน เนื่องจากปัญหาด้านนโยบายในการพัฒนาบุคลากร ยังขาดความต่อเนื่องและขาดการคัดสรรเจ้าหน้าที่มาปฏิบัติมาอย่างจริงจัง การศึกษาแนวทางการปฏิบัติงานแบบสหวิชาชีพพบว่าการปฏิบัติงานแบบสหวิชาชีพจำเป็นต่อการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ และรูปแบบการปฏิบัติแบบสหวิชาชีพเป็นรูปแบบประสานงาน ซึ่งปฏิบัติงานภายใต้ประมวลกฎหมายพิจารณาความอาญา (ฉบับที่ 20) ส่วนรูปแบบการปฏิบัติงานแบบสหวิชาชีพนั้นมีกระบวนการปฏิบัติงาน ประกอบด้วย 5 ขั้นตอน คือ การติดต่อสื่อสาร การประนีประนอม การประสานงาน ความร่วมมือและการประมวลผล ในและแต่ละขั้นตอนอาจจะมีลักษณะการปฏิบัติงานมากกว่า 1 ขั้นตอน ซึ่งการปฏิบัติงานต้องเป็นไปตามลักษณะและเหตุการณ์ของปัญหาที่เกิดขึ้น ข้อเสนอแนะต่อแนวทางการปฏิบัติงานแบบสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ ควรมีการปรับปรุงนโยบายการปฏิบัติงานทางภาครัฐ โดยเฉพาะนโยบายการปฏิบัติงานแบบสหวิชาชีพควรมีความชัดเจน ต่อเนื่อง จึงจะสามารถทำให้รูปแบบการปฏิบัติงานแบบสหวิชาชีพเป็นไปอย่างจริงจัง เนื่องจากหน่วยงานภาครัฐเป็นแกนหลักการปฏิบัติ งานแบบสหวิชาชีพในการให้ความช่วยเหลือเด็กที่ถูกกระทำทารุณกรรมทางเพศ แต่ลักษณะงานที่ ปรากฏขึ้นในปัจจุบันเน้นรูปแบบการส่งต่อไปยังหน่วยงานต่าง ๆ ที่เกี่ยวข้องต่อการให้ความช่วยเหลือแต่กลับขาดความรับผิดชอบร่วมกันในการปฏิบัติงาน

The objective of this study is to understand the problems and obstacles in carrying out the interdisciplinary practice in assisting child sexually abused. The study also tries to find out ways to properly handle the practice. This research is carried out by basing on the information obtained from persons who perform the interdisciplinary practice. Those persons including doctors, nurses, social workers, psychiatrists, police, and attorneys work in both private and governmental organizations located in Bangkok and vicinity. The study contents are about learning and understanding the interdisciplinary practice, responsibilities of professional and legal measures. This will\ lead to suggestions on how to effectively handle the interdisciplinary practice in assisting child sexually abused. The study reveals the problems and obstacles in performing the interdisciplinary practice in assisting child sexually abused as follows: 1.Problems and obstacles on policy, generally policy is not clear and discontinuous. This causes in perspective and impression leading to diversification in the direction of interdisciplinary. 2.Problems and obstacles in the working procedure and steps, lack of the budgeting support in the past led to very little effort spent in handling the interdisciplinary practice. Slow and very little budgeting support can create disincentive to follow the guideline on interdisciplinary practice leading to limited material and equipment. Subsequently, poor performance is unavoidable. 3.Problems and obstacles in the cooperation, problems in cooperation cause some working overlap and misunderstanding leading to mind conflicts within the working team. Sometime cooperation is too little to get a mission accomplished. 4.Problems and obstacles on the readiness of staff, staff who have skill on the interdisciplinary practice in assisting child sexually abused are not enough in terms of number and capacity. The main cause of these problems is the policy on personnel development lacks of continuity. Moreover, the personnel selective process is not seriously handled. It is certain that the interdisciplinary practice is necessary in assisting child sexually abused. Basically, the practical is a cooperation form carried out under the criminal law (20th edition). Five steps needed in performing the interdisciplinary practice are communication, compromise, coordination, cooperation, and evaluation. It is worth mentioned that any single stoe may consist of two steps depending on the characteristic and event of the problem. The thesis suggests that in order to make the interdisciplinary practice in assisting child sexually abused really practical the government sector must have a clear and continuous policy on this issue since the government unit is the core of its operation. Currently, the task in assisting child sexually abused will be practically passed on to the related organizations without any responsibility shared by the government part.
