การเมืองภาคพลเมืองของคนพิการในการทำสิทธิคนพิการให้เป็นจริง

Abstract

สิทธิคนพิการเป็นจริงได้ เพราะผู้นำคนพิการรวมกลุ่ม พึ่งตนเอง และขับเคลื่อนอย่างต่อเนื่องและเข้มแข็ง แต่ในปัจจุบันพลังกลุ่มลดระดับความเข้มข้นของการขับเคลื่อนลงอย่างน่าเป็นห่วงคนพิการโดยเฉพาะอย่างยิ่งในชนบทเข้าไม่ถึงสิทธิในขณะที่กฎหมาย นโยบายและระเบียบปฏิบัติต่างๆ มีความก้าวหน้าและทันสมัย การศึกษานี้มีวัตถุประสงค์ 3 ประการคือ 1) ศึกษาคุณลักษณะและภาวะผู้นำของผู้นำคนพิการที่เข้ามาขับเคลื่อนงานด้านสิทธิคนพิการ 2) ศึกษาการจัดการองค์กรและการจัดการขบวนการทางสังคมของคนพิการ และ 3) ศึกษายุทธศาสตร์ของผู้นำและขบวนการทางสังคมของคนพิการในการทำสิทธิของคนพิการให้เป็นจริง อันเป็นกลไกสำคัญในการส่งเสริมและพัฒนาคุณภาพชีวิตคนพิการในทุกมิติ โดยศึกษาเชิงคุณภาพกล่าวคือศึกษาการรวมกลุ่มและการขับเคลื่อนยุทธศาสตร์ของผู้นำคนพิการ ตั้งแต่ปี 2510-2560 ถอดความรู้จากการฟังผู้ให้ข้อมูลหลักซึ่งประกอบด้วยผู้นำคนพิการทุกประเภท 32 คน และผู้ทรงคุณวุฒิ 10 คน เป็นการเล่าเรื่องจากความทรงจำ สอบทานด้วยข้อมูลเชิงประวัติศาสตร์ รวมถึงการตีความ วิพากษ์ และกำหนดสร้างความรู้อันเป็นบทเรียน เพื่อนำไปสู่การทำให้สิทธิคนพิการเป็นจริง ผลการศึกษาพบว่า ภาวะผู้นำของคนพิการเกิดจากประสบการณ์ที่ไม่ยอมจำนนต่อความไม่เป็นธรรมในการเข้าถึงและใช้ประโยชน์จากสิทธิที่ตนเองหรือเพื่อนคนพิการเผชิญ การลุกขึ้นมาขับเคลื่อนเพื่อช่วยคนพิการด้วยกันกลายเป็นจุดเปลี่ยนในชีวิต เกิดการรวมกลุ่ม จัดตั้งองค์กร และเครือข่ายทั้งในกลุ่มคนพิการ การทำงานร่วมกับข้าราชการ นักการเมือง และองค์กรภาคประชาชน การจัดการองค์กรของคนพิการ ส่วนมากเป็นแบบทางการและมีลำดับชั้นการบริหาร สามารถเข้าถึงอำนาจรัฐได้ทั้งทางตรงและทางอ้อม เป็นการเมืองภาคพลเมืองของคนพิการที่ผลักดันให้เกิดกฎหาย แผน นโยบายด้านคนพิการ ผู้ศึกษามีข้อเสนอเพื่อขับเคลื่อนสิทธิคนพิการให้เป็นจริงแบบทวิภาค คือ 1) การจัดสมัชชาคนพิการ และ 2) การคุ้มครองและพิทักษ์สิทธิคนพิการ โดยใช้ 3 ยุทธศาสตร์ คือ 1) การเสิรมพลังอำนาจคนพิการพลเมืองไทยสู่ผู้นำการเปลี่ยนแปลง 2) การสร้างเครือข่ายองค์กรด้านคนพิการและภาคประชาสังคม และ 3) การสื่อสารสังคมสู่สังคมฐานสิทธิ

The most effective way in making persons with disabilities (PWD) rights a reality is the civil politics movement organized by PWD leaders. However those movements have been seemed to gradually reduce the strength achievement activities. At the present the majority of PWD, especially those living in the rural areas, still face difficulty having their rights respected, even though the National Policy, Law and Regulations to promote the PWD quality of life is quite progressive and modernized. Studying the subject mentioned composes of 3 objectives: 1) to study the characteristics and leadership of PWD leaders; 2) to study the management of PWD organizations and its social movements; 3) to study the strategies of the PWD leaders and its social movements. This study is a qualitative study which has studied the collective movements of the PWD from 1967-2017. The data was collected using a dialogic approach; interviewing key informantsm namely 32 PWD leaders of all disability types and 10 specialists. The information came mainly through personal memories, anecdotes and historical data. The research has shown that successful PWD leaders and their movements come from a shared experiences with a view of the betterment of all PWD and not just one's self and the immediate group of frients and acquaintances. Standing up and help others is the turning point to assisting other PWD. Collective movement starts by forming local community based organizations and a national network of PWD, working together with government officials, politicians and civil society to work on legislations, plans and policies to improve the quality of life and to male the rights for PWD a reality. The researcher is confident to propose the 'Duet Track Disabilities Movement' as follow; 1) to organize the assemblies of PWD, and 2) to promote and advocate the rights of PWD by using 3 strategies: i. Empower Thai PWD to become leaders of change ii. Create the network among PWD movements and civil society and iii. Communicate and educate to the public a rights based society.
