พระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑ์สถานแห่งชาติ พ.ศ. 2504 กับการจัดตั้งพิพิธภัณฑ์ท้องถิ่น

Abstract

พระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ พุทธศักราช 2504 แก้ไขเพิ่มเติมโดยพระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ (ฉบับที่ 2) พุทธศักราช 2535 มีหลักการสำคัญเพื่ออนุรักษ์ ปกป้อง คุ้มครอง และรักษาโบราณสถานโบราณวัตถุ ศิลปวัตถุ ตลอดมา และในขณะเดียวกันที่รัฐธรรมนูญแห่งราชอาณาจักรไทย ตั้งแต่ พุทธศักราช 2540 เป็นต้นมา ให้ความสำคัญในการกำหนดสิทธิและหน้าที่ ให้ปวงชนชาวไทยมีส่วนร่วมในการอนุรักษ์ ฟื้นฟูจารีตประเพณีภูมิปัญญาท้องถิ่น ศิลปวัฒนธรรมอันดี โดยรัฐต้องส่งเสริมและสนับสนุนการเรียนรู้ ปลูกจิตสำนึก และเผยแพร่ศิลปวัฒนธรรม ขนบธรรมเนียมประเพณีและภูมิปัญญาท้องถิ่นด้วย บทความนี้มุ่งวิเคราะห์พระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุและพิพิธภัณฑสถานแห่งชาติ พ.ศ.2504 ถึงความเป็นไปได้ที่จะเอื้อต่อสภาพปัจจุบันที่มีพิพิธภัณฑ์ท้องถิ่นเกิดขึ้นมากมาย ทั้งที่เป็นของเอกชน ของชุมชน อันเป็นแหล่งเรียนรู้และรวบรวมองค์ความรู้ ภูมิปัญญาท้องถิ่น ข้อเสนอแนะและแนวทางการแก้ไขปัญหาเพื่อเป็นการสนับสนุนและมีส่วนช่วยให้ชุมชนได้มีส่วนร่วมในการจัดการพิพิธภัณฑ์ท้องถิ่น ให้เกิดประโยชน์สูงสุดและตรงตามเจตนารมณ์ของรัฐธรรมนูญที่มุ่งคุ้มครองสิทธิชุมชนในการดำรงรักษาและสืบทอดวัฒนธรรมประเพณีให้คงอยู่สืบไป

Act on Ancient Monument, Antiques, Object of Art and National Museums, B.E.2504 amended by Act on Ancient Monument, Antiques, Object of Art and National Museums (No 2), B.E.2535 are key to conservation, protection and preservation of all historic monuments and art objects. In the same time, Since B.E.2540, The Constitution of the Kingdom of Thailand focus on the rights and duties of people involving conservation, restoration of local tradition arts and culture. The State shall promote and support learning, awareness and dissemination of art and culture, traditions, and local wisdom. This Article aims to analyze Act on Ancient Monument, Antiques, Object of Art and National Museums, B.E. 2504 for possibility that current conditions are conducive to a local museum, which happens a lot. Both are privately owned community as a source of learning and gathering knowledge, local wisdom. To achieve the maximum benefits and meet the spirit of the Constitution aimed protecting community rights to maintain cultural traditions and to remain forever, this article also covers the suggestions and solutions to support and contribute the community, which have been involved in the management of local museum.
