สิทธิ เสรีภาพ และความเสมอภาคของคนพิการกับระบบขนส่งมวลชน : บทเรียนจากคดีระบบรถไฟฟ้าบีทีเอส

Abstract

ระบบขนส่งมวลชนถือเป็นบริการสาธารณะอย่างหนึ่งของรัฐ ซึ่งหลักการพื้นฐานสำคัญของการจัดทำบริการสาธารณะ คือหลักความเสมอภาค อันเป็นหลักประกันแก่ประชาชนทุกคนว่า การจัดบริการสาธารณะของรัฐมิได้มีจุดมุ่งหมายเพื่อประโยชน์ของผู้ใดผู้หนึ่ง แต่เป็นการจัดทำเพื่อประโยชน์ของประชาชนทุกคน อันหมายรวมถึงคนพิการที่จะต้องเข้าถึงสิทธิในระบบขนส่งมวลชนด้วย อย่างไรก็ตาม ปัจจุบันคนพิการในประเทศไทยยังประสบปัญหาการเข้าไม่ถึงระบบขนส่งมวลชน ดังจะเห็นได้จากคดีระบบรถไฟฟ้าบีทีเอสที่คนพิการได้ฟ้องร้องสู่ศาลปกครอง บทความนี้จึงนำเสนอถึงปัญหาด้านสิทธิ เสรีภาพ และความเสมอภาคของคนพิการในระบบขนส่งมวลชนที่สะท้อนจากแนวคำพิพากษา ตลอดจนปัญหาของการบังคับให้หน่วยงานของรัฐต้องปฏิบัติตามคำพิพากษาของศาลดังกล่าว

The public transportation system is considered a public service of the state. The basic principles of public service is the principle of equality which is a guarantee to all people that public service of the state is not intended for the benefit of any one person but is for the benefit of all people, including disable persons who have access to rights in public transportation system. However, disable persons in Thailand still face problems of access to public transportation system. As can be seen from the administrative case of the BTS system. This article aims to study the rights and equality of disable persons in public transportation system in accordance with the judgment and the problem of forcing the government agencies to comply with the judgment.
