การคุ้มครองทางสังคมภายใต้ระบบสวัสดิการสังคมไทย และคุณภาพชีวิตของแรงงานข้ามชาติ

Abstract

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษา สถานการณ์ของแรงงานข้ามชาติในจังหวัดสมุทรปราการ การคุ้มครองทางสังคมภายใต้ระบบสวัสดิการสังคมไทยและคุณภาพชีวิตของแรงงานข้ามชาติ รวมถึงแนวทางที่เหมาะสมในการคุ้มครองทางสังคมและพัฒนาคุณภาพชีวิตของแรงงานข้ามชาติที่เข้ามาทำงานในประเทศไทย โดยใช้วิธีวิจัยแบบผสมผสาน การวิจัยเชิงปริมาณ ใช้แบบสอบถามเป็นเครื่องมือ สุ่มกลุ่มตัวอย่างแบบชั้นภูมิ ครอบคลุมพื้นที่ทุกอำเภอ เป็นแรงงานข้ามชาติที่เข้ามาทำงานในระบบอย่างถูกต้องตามกฎหมาย ได้แก่ สัญชาติเมียนมา ลาว และกัมพูชา จำนวน 412 คน วิเคราะห์ข้อมูลด้วยสถิติเชิงพรรณนา การวิจัยเชิงคุณภาพ ใช้การสัมภาษณ์แบบกึ่งโครงสร้างและการสนทนากลุ่ม จากผู้ให้ข้อมูลหลัก 16 คน ผลการวิจัยพบว่า สถานการณ์แรงงานข้ามชาติในจังหวัดสมุทรปราการส่วนมากได้รับการคุ้มครองทางสังคมภายใต้ระบบสวัสดิการสังคมไทย มากกว่าร้อยละ 90 ตามองค์ประกอบคุณภาพชีวิต4 ด้านขององค์การอนามัยโลก ผลการศึกษาพบว่า ด้านร่างกาย ด้านจิตใจ ด้านสัมพันธภาพทางสังคมอยู่ในระดับดี ค่าเฉลี่ยเท่ากับ 37.6 ส่วนด้านสิ่งแวดล้อมอยู่ในระดับปานกลาง ซึ่งเป็นโอกาสในการพัฒนาเพื่อการยกระดับคุณภาพชีวิต (OFI) หน่วยงานภาครัฐ และภาคเอกชน รวมถึงภาคีเครือข่ายเห็นตรงกันว่า จังหวัดสมุทรปราการ และประเทศไทยไม่มีแรงงานข้ามชาติเข้ามาช่วยทำงานที่คนไทยไม่ทำไม่ได้ เพราะจะส่งผลกระทบต่อเศรษฐกิจ และขาดความสมดุลของประชากรในอนาคต ซึ่งเป็นสังคมผู้สูงอายุและอัตราการเกิดน้อย แนวทางที่เหมาะสมในการคุ้มครองทางสังคม และพัฒนาคุณภาพชีวิตของแรงงานข้ามชาติ ควรกำหนดขั้นตอนการดำเนินงานต่างๆ ควรเข้าใจง่าย ไม่ซับซ้อน มีการวางระบบการขับเคลื่อนการดำเนินงานระยะยาว ถึงแม้ประเทศไทยจะมีการออกกฎหมายรองรับตามสากล และบริบทของประเทศไทยที่ดีและครอบคลุม แต่การส่งเสริมการบังคับใช้กฎหมายให้ไปสู่การปฏิบัติได้จริงและแรงงานข้ามชาติสามารถเข้าถึงและได้รับการดูแลตามกฎหมายอย่างทั่วถึง เท่าเทียมเป็นสิ่งที่มีความสำคัญ ระบบฐานข้อมูลควรเป็นฐานข้อมูลเดียวกัน การกำหนดหน่วยงานรับผิดชอบที่ชัดเจน เช่น การกำหนดให้มี “กรมแรงงานข้ามชาติ” หรือให้มีองค์กรอิสระเพื่อมาควบคุมดูแลรับผิดชอบโดยตรง เช่น การจัดตั้ง “สำนักงานคณะกรรมการแรงงานข้ามชาติ” เพื่อกำกับดูแล นอกจากนั้นการส่งเสริมให้คนไทย นายจ้างมีทัศนคติเชิงบวก เห็นคุณค่าของแรงงานข้ามชาติไม่มองเป็นบุคคลชั้นสองควบคู่ไปกับการส่งเสริมการดำเนินงานงานของหน่วยงานภาครัฐที่เกี่ยวข้องปฏิบัติตามภาระหน้าที่ที่รับผิดชอบอย่างมีประสิทธิภาพ โดยมีองค์กรเอกชน และภาคส่วนอื่นๆ ให้การสนับสนุน จะส่งผลให้แรงงานข้ามชาติมีคุณภาพชีวิตที่ดีทั้งในสถานการณ์ปกติ และในสถานการณ์สาธารณภัยต่าง ๆ ตามหลักสิทธิมนุษยชน

This research aims to study the situation of migrant workers in Samut Prakan Province. Social protection under the Thai social welfare system and the quality of life of migrant workers, including appropriate approaches to social protection and development of the quality of life of migrant workers who come to work in Thailand, uses a mixed methods research method. Qualitative research using semi-structured interviews and focus groups from 16 key informants found that the situation of migrant workers in Samut Prakan Province mostly receive social protection under the Thai social welfare system, more than 90% according to the components. The 4 dimensions of quality of life according to the World Health Organization: physical, mental, and social relationships are at a good level with an average of 37.6, while the environmental aspect is at a moderate level, which is an opportunity for development to improve quality of life. (OFI) Government and private sector agencies, including network partners, agree that Samut Prakan Province and Thailand do not have migrant workers to help with work that Thai people cannot do because it will affect the economy and the population will be unbalanced in the future, which is an ageing society and a low birth rate. An appropriate approach to social protection and improving the quality of life of migrant workers should establish various procedures. It should be easy to understand, not complicated, and have a system in place to drive long-term operations. Even though Thailand has laws to support international standards and the Thai context that are good and comprehensive, promoting law enforcement into practice and allowing migrant workers to have access to and receive equal legal care is important. What is important, there should be the same database system, with clearly defined responsible departments, such as specifying "Department of Migrant Labor" or having an independent organization to directly supervise and take responsibility, such as establishing the "Office of the Migrant Labor Committee" to supervise.
